These Terms of Use ("Terms") govern your use of Tote, the website at tote.co.nz, and the Tote mobile apps (together, the "Service"). By creating an account or using the Service, you agree to these Terms.

You may use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to infringe anyone's rights, to disrupt its operation, or to attempt to access data that you are not authorised to see.
You can sign in with your Google or Apple account. You are responsible for keeping your account credentials secure and for what happens under your account.
Tote shows supermarket prices, specials, and product information that we collect and update regularly. Prices change often and store data can be incomplete or out of date, so the information is provided as a guide only. You should always check the price shown at the till before paying.
Tote Pro is an optional monthly subscription. Unless you cancel before the end of a free trial, the subscription renews automatically each month at the then-current price until you cancel. You can manage or cancel your subscription from your device's app store settings (for iOS and Android) or through your payment provider (for web).
Payment for Tote Pro is handled by our payment providers, not by us directly. We do not store your payment card details. Refunds are considered on a case-by-case basis — if you believe you were charged incorrectly, email us at [email protected] and we'll review it.
The Service, including its software, design, and branding, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, or redistribute it except as permitted by these Terms. Grocery prices, specials, and product details are provided for your personal, non-commercial use.
Recipe generation and import features use AI to produce suggestions based on the information you provide. AI output can be inaccurate or unsuitable, and you are responsible for reviewing it — including checking ingredients against allergies and dietary needs — before relying on it.
The Service may link to third-party websites, apps, or services. We do not control them and are not responsible for their content or their privacy practices.
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we make no warranties about the accuracy, reliability, or availability of the Service or the information it shows.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential loss arising out of your use of the Service, including reliance on price information or AI-generated content.
You can stop using the Service at any time, and you can delete your account from within the app. We may suspend or terminate access to the Service if you breach these Terms.
We may update these Terms from time to time. When we do, we will update the "Last updated" date above. If a change is significant, we will notify you in the Service. Continued use of the Service after changes means you accept the updated Terms.
These Terms are governed by the laws of New Zealand, and any disputes are subject to the exclusive jurisdiction of the New Zealand courts.
